Unspoken Boundaries® Policies

Cancellation Policy

There is no cancellation for On-Demand Video Workshops.

Pre-registration for all live events, whether online, local, or international, is required.

If you cannot attend the event, at minimum, a two-week cancellation notice is required for a 90% refund. If Merle Yost cancels the event, you will receive a credit for the next event or a full refund. If you can’t attend without the two-week cancellation notice, you will forfeit the registration fee.

Registration Policy

Event registration must be paid online except with prior approval. Registration dates and fees may vary and are subject to change without notice. Event discounts prices and discount periods may or may not be offered. Event registration is deemed complete during the registration period in which registration payment is received. Incomplete or unpaid registration will be cancelled and removed at the end of each registration period.

Refund Policy

Unspoken Boundaries is fully committed to conducting all activities strictly adhering to California Association of Marriage and Family Therapists (CAMFT) guidelines for Continuing Education Units.

Unspoken Boundaries complies with all legal and ethical responsibilities to be non-discriminatory in promotional activities, program content, and the treatment of program participants.

Merle Yost, LMFT, Instructor and CE Administrator Christina Viani, LMFT and leadership team members assume ultimate responsibility for monitoring and assessing compliance with these principles.

Unspoken Boundaries’ Program Administration team are responsible for implementing Unspoken Boundaries’ procedures for addressing complaints in a reasonable, ethical, and timely fashion.

PROCEDURES

Refund requests will be reviewed on an individual basis.

A representative of Unspoken Boundaries will attempt to negotiate an acceptable solution for live in-person events where a refund has been requested due to extreme unforeseeable circumstances. This may include credit towards a future workshop.

For on-demand workshops, payments are non-refundable after the user has accessed any course component.

Certificates cannot be given for partial completion of the program.

While Unspoken Boundaries goes to great lengths to ensure fair treatment for all participants and attempts to anticipate problems, occasional issues will come to the staff's attention that require intervention and action.

This procedural description serves as a guideline for handling grievances.

When a participant, either orally or in written format, files a grievance and expects action on the complaint, the following actions will be taken:

If the grievance concerns an aspect of Unspoken Boundaries’ CE programming related to content, speaker, or course delivery, a representative of Unspoken Boundaries will investigate and attempt to address the grievance by identifying the nature of the grievance and the participant's desired outcomes. The representative will attempt to mediate the situation.

Please note: All actions will be documented in writing by NICABM staff for record-keeping purposes. Documentation need not be shared nor signed by the grieved individual.

The instructor and CE Administrator will be the final arbitrator in all grievances and refunds.

Grievance Policy

Merle Yost is fully committed to conducting all activities in strict conformance with the California Association of Marriage and Family Therapists. He will comply with all legal and ethical responsibilities to be non-discriminatory in promotional activities, program content, and the treatment of program participants. Merle Yost will be responsible for monitoring and assessing compliance with these standards.

While Merle Yost goes to great lengths to assure fair treatment for all participants and attempts to anticipate problems, occasional issues will come to the attention of a Program Committee, which will require intervention and action on the part of the Program Committee. A group of Licensed Therapists will be asked to review any issues brought to their attention.

This procedural description serves as a guideline for handling such grievances.

When a participant files a grievance and expects action on the complaint, the following actions will be taken:

The participants will be asked to put their concerns in writing.

If the grievance concerns A) a speaker, B) the content presented by the speaker, or C) the presentation style, then the individual filing the grievance will be asked to put his/her comments in written format. Merle Yost (merle@merleyost.com) will then pass on the comments to the speaker, assuring the confidentiality of the grieved individual.

If the grievance concerns a workshop or training offering, its content, level of presentation, or the facilities in which the workshop was offered, these concerns will be addressed by:

a. attempt to move the participant to another workshop or

b. provide a credit for the workshop or

c. provide a partial or full refund of the workshop fee.

d. allow the person to be heard via a meeting/discussion.

Actions 3b and 3c will require a written note documenting the grievance for record-keeping purposes.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Website.

We automatically collect certain information when you visit, use, or navigate the Website. This information is primarily needed to maintain the security and operation of our Website and for our internal analytics and reporting purposes.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Website, which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity on the Website (such as the date/time stamps associated with your usage, pages, and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps') and hardware settings).

For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. Note, however, if you choose to opt out, you may be unable to use certain aspects of the Services.

2. HOW DO WE USE YOUR INFORMATION?

In Short: We process your information based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Website for various business purposes described below. • To protect our Services. We may use your information to keep our Website safe and secure (for example, for fraud monitoring and prevention).

  • To enforce our terms, conditions, and policies for business purposes, to comply with legal and regulatory requirements, or in connection with our contract.

  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

  • To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes if this is in accordance with your marketing preferences. For example, when expressing an interest in obtaining information about us or our Website, subscribing to marketing, or otherwise contacting us, we will collect personal information from you. You can opt out of our marketing emails anytime (see the "WHAT ARE YOUR PRIVACY RIGHTS?" below).

  • Deliver targeted advertising to you. We may use your information to develop and display personalized content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.

  • For other business purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improving our Website, products, marketing, and your experience. We may use and store this information in aggregated and anonymized form so that it is not associated with individual end users and does not include personal information. We will not use identifiable personal information without your consent.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short: We only share information with your consent to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

We may process or share your data that we hold based on the following legal basis:

  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

  • Legal Obligations: We may disclose your information where we are legally required to do so to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or act regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy notice. Affiliates include any subsidiaries, joint venture partners, or other companies we control or are under common control.

4. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

5. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through organizational and technical security measures.

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk. You should only access the Website within a secure environment.

6. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account anytime.

If you are a resident in the EEA or UK and believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. 7. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers, mobile operating systems, and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference and not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized at this stage. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.
